Terms and Conditions

1.1. We are Arup - entity in Serbia - Arup doo Beograd (Vracar), further in the text seen as “Arup”. Our iOS and Android applications are in no way affiliated with, sponsored or supervised by Apple Inc. or Google LLC.

1.2. These General Terms and Conditions of Use of MaPLoRds (hereinafter: Terms and / or User Agreement) determine the terms of access and use of MaPLoRds software, apply to our Android and iOS application MaPLoRds and the web application http://maplords.rgf.bg.ac.rs/ and with any other MaPLoRds services and products, including user accounts, user and technical support, blogs and social networking services, etc. (hereinafter common name for all of the above: MaPLoRds services).

1.3. Arup may make changes to the Terms from time to time, so we advise you to occasionally check which version of the Terms is currently valid by looking at http://maplords.rgf.bg.ac.rs/ or within our Android and iOS application "MaPLoRds".

1.4. These Terms apply from the time you download, install or use any of the MaPLoRds services, including the MaPLoRds application, and you agree to the rights and obligations of the current version of these Terms.

1.5. FBy agreeing to these Terms you also acknowledge that you have read and understood our Privacy Policy, which is an integral part of these Terms. It contains important information regarding the data we use, how we collect and protect, how we provide consent, etc.,and can be reviewed by clicking here. Also, if there are any additional documents related to the conditions and use of individual MaPLoRds services agreed between us, they are deemed to be an integral part of these Terms.

1.6. The application "MaPLoRds" (hereinafter: the Application), which is owned by us, allows the user, as an individual, through entertainment and interaction, to use the map and mark risk points on it for the purpose of their potential elimination. The application is constantly being developed and improved, administered, protected as an intellectual property, and offered for free download by users on the app stores of Google LLC and Apple Inc.

2.1. By accepting these Terms, the user agrees to the following rights and obligations:

  1. To use MaPLoRds services, there is no age limit;

  2. MaPLoRds services, and in particular the Application, may be used by the user or by a person authorized by the user to use it on the user's device or through the user's user account, provided that MaPLoRds cannot identify a third party or guarantee the use and / or prohibit the use of the MaPLoRds services, if you have personally allowed another person to use our services. The application can be used only on authorized devices (if it is installed on devices that are legally owned or owned by the user).

  3. It is not allowed to submit incorrect information or misrepresentation. You are not allowed to make an order on behalf of another person unless you have their prior express consent. Since we do not have the possibility to verify, in any case we will consider that the user is the same person who submitted the data during registration and who uses MaPLoRds services.

  4. We reserve the right to reject any user account if it violates this User Agreement or other applicable MaPLoRds service rules;

  5. Users who have previously deleted their accounts and blocked the use of MaPLoRds services, especially the Application, or who have violated, abused any of the obligations under the Terms, or applicable laws related to the purpose and use of our services, are expressly prohibited from using MaPLoRds services again.

  6. The user is granted the right of usage, which includes a limited, non-exclusive, non-transferable, free license to download and install, as well as access to MaPLoRds services, exclusively for personal, non-commercial use in accordance with these Terms.

  7. Any illegal, impermissible, fraudulent act, an act that can mislead someone, is forbidden. You are not allowed to perform any actions that may interfere with the work of the MaPLoRds services, other users of the MaPLoRds services, disruption, collection of information in any way, including automation, etc. Also, it is not allowed to violate these Terms or encourage third parties to violate these Terms, and we also advise you to report any violations to the address of our Help Center: http://maplords.rgf.bg.ac.rs/

  8. It is expressly forbidden to do or attempt to do so, to buy, sell, assign with or without charge, any part of your account (including username), seek, collect or use the credentials of other users to log in.

  9. In particular, the user is prohibited from:
    • any activity that is harmful, prohibited by law, pornographic, obscene in any way, offensive, harassing, hateful, or inadmissible in any way that may be considered unworthy or undesirable
    • any activity, even an attempt to harm, misuse, harass, hack, threaten or abuse MaPLoRds services, in whole or in part, or other users of MaPLoRds services
    • to create and use of multiple accounts from one access point (phone / device), unusually large number of registrations and unsubscriptions to the service from one access point
    • It is forbidden to create, use, make available or distribute any automated software, robot, bot, extraction tools or other software that may in any way affect or communicate with MaPLoRds services in any way - including without limitation any unauthorized third party programs that intercept, mimic any communication with MaPLoRds or partners and MaPLoRds services and / or any unauthorized third party program that collects information about MaPLoRds services and stores data);
    • Any activity involving interference with or interference with the MaPLoRds service, including code insertion or insertion, tunneling, denial of service, modification of software, use of software that mimics our software, protocol emulation, creation and use of private servers or any similar services related to MaPLoRds services, including interception, data collection so-called data mining activities using unauthorized software or programs. Also, do not attempt to access or attempt to access parts of the MaPLoRds service or servers that have not been made publicly available by us.
    • Only use your user account, as well as any part of the MaPLoRds service for the intended purposes or specified in these Terms. Any activity related to the installation of any files containing malicious code, viruses, "Trojans", etc., including any intentionally damaged files or other files containing malicious code that may in any way damage or interfere with the MaPLoRds service is prohibited;
    • any activity that may infringe or infringe the rights of a third party with respect to intellectual property, data privacy, publicity or other rights;
    • unauthorized advertising, promotional or commercial communications, trade and / or sales
    • transfer of malicious or unauthorized software;
    • share with third parties your username, password, or any access to control information that provides access to or use of the MaPLoRds services;
    • any activity that may interfere with or disrupt the MaPLoRds services;
    • collecting any personally identifiable information on MaPLoRds services;
    • committing any act similar to the one mentioned above which is prohibited in accordance with legal regulations and other legal acts.

  10. When registering on MaPLoRds services, if you choose a username or specific identification for your profile that is not adequate, we may request a change if we find it necessary (e.g. it is already in use, violates someone's rights, etc.).

  11. The user agrees to give us permission to use the username, information related to the use of the MaPLoRds service and actions on the account.

  12. Some MaPLoRds services allow a user to create, post or share content using the same (hereinafter: User Content), such as posting photos, comments, usernames or other content. The user owns their own User Content. User grants Arup a non-exclusive, perpetual, irrevocable, free, fully paid, transferable, territorially unlimited license, including the ability to sublicense, use, publish, modify, reproduce, distribute, prepare derivative works, display, perform or otherwise fully exploits User Content in connection with MaPLoRds services and MaPLoRds business (including legal successors and assignees), which includes without limitation the right to promote and redistribute part or all of MaPLoRds services on any media or through media channels (including without limitation and third party web sites).

  13. The user expressly guarantees:
    • to have all the rights for User Content or, alternatively, to have the rights to transfer to Arup all the rights listed in the previous point l. of these Terms
    • that User Content does not violate any applicable law, rule, regulation, or any obligation defined in these Terms.

  14. Arup is not responsible for User Content, nor is it obliged to monitor the MaPLoRds service or any part of the content published by the user, etc. and has the right to:
    • refuses to accept or transmit User Content,
    • remove or block any User Content within the MaPLoRds service, for any reason, without prior notice to the User.

  15. User Content marked as "private" by the user through the MaPLoRds service, if this option is enabled, will not be publicly available.

  16. Arup and / or other users may copy, print or publicly post available User Content outside of the Arup service without restriction. If the user at any time marks the public User Content as "private", MaPLoRds will stop further distribution of such User Content outside the MaPLoRds service, as soon as the realistic conditions for this are created, if this option is enabled.

  17. Upon receipt of adequate notice, User Content or other content that infringes copyright and / or related rights and intellectual property rights will be removed. Orders or repeated infringements will be terminated.

  18. We may remove content or information from your profile if you violate the provisions of these Terms or other rules and procedures that are an integral part of these Terms, or if it is in accordance with the provisions of the law. We may refuse to provide MaPLoRds services in whole or in part, which includes disabling or terminating your profile, without delay in order to protect our service, if you violate the rights of others and continue to infringe, violate the provisions of these Terms and other rules and procedures part of these Terms, or if we are required to do so in accordance with the provisions of applicable law. In the event that we have disabled your use of the MaPLoRds service or terminated your profile, we will notify you of the above in the event that it is possible. If you believe that your profile has been terminated due to an error, or you wish to personally disable or permanently terminate your profile, please contact our support center: belgrade@arup.com

  19. Content that has been deleted may be stored for a certain period of time for the purpose of our archive in accordance with legal regulations, after which it will be permanently deleted. You can find more about data storage and protection in our Privacy Policy.

  20. You may not use any content that is protected and related to the MaPLoRds services that we provide, which means that you have no right to modify, modify, decompile, make any attempt to extract the source code, etc., without our prior written consent.

  21. The user agrees that we can automatically download and install the MaPLoRds service update on his device, which includes an update in order to repair any "bugs". We reserve the right to periodically disable, modify, or discontinue, permanently or temporarily, the provision of the MaPLoRds services (or any part thereof), with or without notice. Additionally, we may terminate access to part or all the MaPLoRds service to a user at any time, with or without reason, with or without notice, with immediate effect, which may result in the revocation or complete destruction of all user account information on MaPLoRds services.
    • The user can open, maintain, use and control only one account. Users are expressly prohibited from being owners or co-owners of other accounts.
    • Arup expressly reserves the right to deactivate registered accounts that it believes have been generated by automated means or programmer automations or that violate these Terms of Use. Registered accounts generated by a software script, bots or other automated means will be considered invalid, i.e. they will be deactivated.
    • Arup for the purposes of monitoring and control of the Application in all its parts has the right to terminate the User's access to Arup services in whole or in part at any time in case of violation of these General Terms and Conditions, and without reason, at any time, with prior notice. In the event that MaPLoRds terminates or prohibits access to the Application or MaPLoRds services in general and deletes the user account, the user is not entitled to compensation for the inability to use the Application.

2.2. In the event that any provision of these Terms representing the User Agreement is inapplicable, the remainder of the provisions shall remain in full force and effect.

2.3. We reserve any rights, which we have not expressly guaranteed by these Terms.

2.4. This User Agreement does not grant any rights to third parties, and you, as the user, may not transfer any of your rights or obligations, assign, pledge, sell, sublicense or otherwise transfer the rights guaranteed by these Terms to any third parties, organizations or entities.

2.5. We may transfer our rights and obligations to third parties, without any restrictions. For example, this can happen in the event of a change of control or by law.

2.6. We reserve all rights to and in connection with MaPLoRds services, especially in connection with the Application, such as, but not limited to, name, any copyright and related rights, intellectual property rights, etc., without limitation to the entire content of MaPLoRds services, especially Applications.

2.7. These Terms will remain in effect until this User Agreement is terminated. The User Agreement, and your rights and licenses hereunder, will terminate immediately upon your breach of these Terms. You may terminate the User Agreement by uninstalling and discontinuing your use of MaPLoRds. Arup may terminate support of MaPLoRds and/or this User Agreement, or limit or terminate your access to MaPLoRds at any time for any reason.

3.1. Our MaPLoRds services are provided in the so-called. seen condition ("as is") and "as available", and we do not guarantee that it will be completely safe at all times and that it will function perfectly. To the extent permitted by law, we waive all warranties, whether express or implied, including implied warranties, eligibility for any additional purpose and purpose, including commercial, etc. We are not responsible for loss of profit, income, information, data, accidental, special, indirect, direct, etc. damages arising out of or in connection with these Terms in any way, or which may arise in connection with the use of MaPLoRds services such as downloading, installing or using the software, and even if the content, information or profile is deleted in any way, use of the MaPLoRds service by the User, including without limitation, loss or liability arising out of or arising out of or in connection with: a) a software conflict, in connection with the MaPLoRds services software; b) violation of the rights of third parties by the user; c) non-delivery of data, incorrect delivery of data or unauthorized access to data delivery; d) defects or viruses in the software or content, as well as the distribution of defects or viruses through the software or content; e) the use or misuse of the user's personal device or software applications that are on the user's device; or f) the unavailability of the MaPLoRds service. The only remedy for these cases is to stop using the MaPLoRds service.

3.2 The App is made available by Arup to the user free of charge. Accordingly, tTo the maximum extent permitted by applicable law, we are not liable to the user for any indirect, unintentional, consequential, special damages or loss or lost profits arising out of or in connection with MaPLoRds services or these Terms. In no event shall Arup’s total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of fifty US dollars (USD $50.00) or equivalent in local currency. The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.

3.3. The User expressly agrees to release, indemnify, defend and protect us and our affiliates, shareholders, subsidiaries, affiliates, officers, directors, employees, agents and advisors, from and against any and all losses, obligations, claims (including claims) without judgment or malicious), claims, damages or costs, causes of actions, disputes, proceedings, judgments, awards, enforcement and liens, including attorneys' fees and reasonable costs relating to or arising out of the use, installation or retrieval and use MaPLoRds service by the user, user content, or violation of these Terms by the user.

3.4. For any additional information, requests, all questions and concerns regarding the use of the MaPLoRds service, the User may contact us by sending an email to belgrade@arup.com.

3.5. In case of a dispute regarding the application of these Terms, the disputes will be resolved amicably and in case of failure of a peaceful solution, they will be finally resolved before the really competent court in Belgrade, Serbia, by applying and interpreting the positive regulations of the Republic of Serbia.

3.6. From time to time, due to changes and improvements to our MaPLoRds services and business in general, or due to changes in applicable regulations, we may make changes and amendments to these Terms. Unless otherwise provided by law, we will notify you of changes in an appropriate manner by posting them publicly at http://maplords.rgf.bg.ac.rs/ prior to the entry into force of the new terms, so that you will have the opportunity to review changes in a timely manner (e.g., leaving options and via an individual MaPLoRds service, etc.). That way, if you continue to use the MaPLoRds services, you will be bound by the new Terms, and if you do not agree with the changes, you can immediately stop using it as well as delete your profile completely, or we advise you to delete the MaPLoRds services from your device and no longer use the same.

3.7. In the event that any provision of these Terms is declared invalid or inapplicable by the competent authority, it will be replaced by a valid and applicable provision that best corresponds, in terms of meaning and purpose, to the original provision, and the rest of the provisions of the Terms will remain in full force. If the inapplicable provision cannot be replaced by another provision, it will not affect the validity and applicability of other provisions of these Terms.
